Invalidation proceedings may be initiated against a patent for a variety of reasons. For example, in a patent infringement case, the alleged infringer of a patent may desire to show that the patent-in-suit is invalid or unenforceable. A person/ company may also want to invalidate a patent if the patent can cause loss of freedom to operate. As all patents are entitled to a presumption of validity, it is necessary to demonstrate invalidity by clear and convincing evidence. These evidences may include patent as well as non-patent literature.
