Opposition Procedings

Opposition proceedings are provided for in some countries to allow an interested party to oppose the grant of a patent. The interested party may oppose the grant of the patent based on grounds of opposition allowed under the respective laws by providing technical and legal arguments and associated references. Filing of an opposition helps interested parties to initiate an action against grant of the patent or to invalidate the patent at a fraction of the cost involved in litigation. • Drafting Opposition letter: An Opposition can be made by the interested party by drafting an Opposition letter. The Opposition letter includes all the references based on which an applicant's claims can be rejected. Drafting the Opposition letter involves prior art search to find one or more references that can be used to oppose an applicant's claims.
• Drafting Response to Opposition: The response is drafted keeping in mind the statutory requirements as mandated by the pertinent patent office. The response to Opposition includes legal as well as technical arguments that can be used to enable the grant of the opposed patent claims.
