Opposition Procedings

Opposition proceedings are provided for in some countries to allow an interested party to oppose the grant of a patent. The interested party may oppose the grant of the patent based on grounds of opposition allowed under the respective laws by providing technical and legal arguments and associated references. Filing of an opposition helps interested parties to initiate an action against grant of the patent or to invalidate the patent at a fraction of the cost involved in litigation.   • Drafting Opposition letter: An Opposition can be made by the interested party by drafting an Opposition letter. The Opposition letter includes all the references based on which an applicant's claims can be rejected.
